Every guest must read and sign this waiver before stepping on board. Please review the entire agreement, then sign at the bottom.
In consideration of being permitted to participate in any recreational boating activity (the “Activity”) operated, organized, or hosted by Turnt Tides LLC, its owners, captains, crew, employees, agents, contractors, vessel owners, and affiliates (collectively, the “Released Parties”), I, the undersigned guest, agree as follows:
1. Assumption of Risk. I understand that boating, swimming, watersports, and being on or near the water involve inherent and significant risks, dangers, and hazards — including but not limited to drowning, slipping, collision, capsizing, propeller injury, exposure to sun, wind, weather, wildlife, equipment failure, illness, the actions of other guests or third parties, and acts of God. I voluntarily and knowingly assume all such risks, both known and unknown, even if arising from the negligence of the Released Parties, and accept full responsibility for any resulting injury, death, illness, loss, or damage to person or property.
2. Release and Waiver. To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the Released Parties from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, injury, or death sustained by me while participating in the Activity, including any caused by the ordinary negligence of the Released Parties.
3. Indemnification. I agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, or costs — including attorneys’ fees — they may incur due to my participation in the Activity.
4. Rules & Captain’s Authority. I agree to follow all safety rules and lawful instructions of the captain and crew at all times. The captain has sole and final authority over the vessel, the route, and the trip, and may refuse boarding, shorten, reroute, or cancel the trip for any safety, weather, or conduct reason. I will not board or remain on the vessel while impaired by drugs or alcohol to a degree that the captain deems unsafe.
5. Alcohol, Personal Belongings & Conduct. Any alcohol consumed on board is consumed at my own risk and responsibility. The Released Parties are not responsible for any loss of or damage to my personal property, electronics, or valuables brought on board.
6. Medical & Insurance. I represent that I am physically fit, have no medical condition that would make participation unsafe, and authorize the Released Parties to seek emergency medical care on my behalf if needed. I am responsible for any resulting medical costs.
7. Media Release. I grant the Released Parties permission to use photos and video of me captured during the Activity for service delivery and, where I have opted in at booking, for marketing — without further compensation.
8. Governing Law & Severability. This Agreement is governed by the laws of the Commonwealth of Kentucky and the State of Ohio (whichever is applicable to the departure point), without regard to conflict-of-laws principles. If any part of this Agreement is held unenforceable, the remainder shall remain in full force and effect.
9. Acknowledgment. I have read this entire Agreement, understand it, and sign it voluntarily. I am at least 18 years of age, or — if I am signing on behalf of a minor — I am the parent or legal guardian and have full authority to bind the minor to this Agreement.
